Compliance and Enforcement
The NEC's Compliance & Enforcement Officer works closely with planning staff to ensure compliance with the Niagara Escarpment Planning and Development Act, Niagara Escarpment Plan and associated Regulations.
The Compliance & Enforcement Officer inspects and reports on works approved by Niagara Escarpment Development Permit. In cases where works are carried out without proper authorization from the Niagara Escarpment Commission, the Officer will notify the proponent of the violation and may lay charges.
The Officer carries out the following duties:
- Provides information to landowners and agents on land use regulations and development guidelines
- Liaises with contractors/excavators on approved work sites
- Liaises with partnering agencies on matters of joint enforcement concern
- Inspects permitted activity sites for compliance with approved permits
- Resolves minor infractions through landowner cooperation
- Resolves violations by notice through discussions, removal, restoration and/or the permit process where possible
- Directs restoration of unauthorized development through issuance of Orders
- Processes legal proceedings when necessary to ensure compliance
The Niagara Escarpment Commission encourages residents residing within the Niagara Escarpment Plan Area to ensure all construction, site and grade alterations, pond excavations, forestry and other environmental land alterations comply with the Niagara Escarpment Planning and Development Act, Niagara Escarpment Plan and associated Regulations.
